Montana Double Proxy Marriage Law
Montana’s double proxy marriage law is unique in the United States, allowing couples to marry without either person being physically present in the state. Under this system, a couple can designate two separate proxies (Montana residents) to stand in for them during the ceremony. This makes Montana particularly popular for military personnel and others who cannot easily arrange to be in the same location for a traditional wedding. The marriage is legally recognized in most states under the Full Faith and Credit Clause of the U.S. Constitution.
To qualify for a double proxy marriage in Montana, at least one member of the couple must be a Montana resident or active duty military. The couple must provide necessary documentation including identification, completed marriage application forms, and proof of military status if applicable. After the ceremony, conducted by the proxies and an officiant, the couple receives a standard marriage certificate that carries the same legal weight as any other marriage performed in the United States.
The Montana double proxy marriage law can be found in the Montana Code Annotated (MCA) under Title 40, Chapter 1, Part 3, specifically in section 40-1-301.
